  1. Introduction
    Welcome to Snapshot Memories. These Terms of Service ("Terms") govern your use of our digitisation services. By engaging with our services, you agree to comply with these Terms. If you do not agree to these Terms, please do not use our services.

  2. Services Provided
    Snapshot Memories provides photo scanning, digitisation, photo enhancement, digital delivery, USB delivery, and related services.

  3. User Responsibilities
    You are responsible for ensuring that all media provided for digitisation are owned by you or that you have obtained all necessary permissions to reproduce and digitise the content.
    You must not submit any material that is illegal, offensive, or infringes the rights of third parties.
    By submitting materials to Snapshot Memories, you consent to their handling, digitisation, temporary storage, processing, and digital delivery in accordance with these Terms.
    Customers acknowledge that photographs, negatives, slides, albums, and other media supplied for digitisation may be fragile, degraded, unstable, or damaged due to age, environmental conditions, adhesives, chemicals, storage history, or prior handling.

  4. Payment
    Our pricing structure is outlined on our website and in your order confirmation. All prices are in Australian dollars (AUD).
    Payment is required in accordance with the terms stated on your invoice. We accept cash, bank transfers, and card payments processed securely via Stripe.
    Any quoted pricing is subject to review where the quantity, condition, or handling requirements of supplied materials differ substantially from the information originally provided.

  5. Shipping and Handling
    Customers are responsible for securely packaging their photos, negatives, slides, albums, and other materials for delivery to Snapshot Memories.
    We strongly recommend using tracked and insured shipping methods where appropriate.
    Snapshot Memories is not liable for any loss, theft, or damage occurring during transit to or from our premises.
    Upon completion of our services, materials will be returned using the agreed delivery method.
    For customers local to Melbourne, in-person drop-off and collection may be arranged by prior agreement.

  6. Turnaround Time
    We aim to complete orders within the estimated timeframe provided at the time of booking or order confirmation. However, turnaround times may vary depending on workload, order size, media condition, and specific service requirements.
    Any estimated turnaround times are indicative only and are not guaranteed. Snapshot Memories will communicate significant delays where reasonably possible.

  7. Refunds and Cancellations
    If you wish to cancel your order, please contact us as soon as possible.
    If cancellation occurs before processing work has commenced, a full refund will generally be provided.
    If work has already commenced, a partial refund may be offered at the discretion of Snapshot Memories based on work completed, labour performed, and materials used.
    Refunds are generally not available once scanning, processing, enhancement, or digital delivery has been completed.
    Customers remain responsible for any applicable return shipping costs regardless of cancellation status.

  8. Service Offerings and Pricing

    • Photo Scans
      The total number of photos submitted determines the pricing tier applied to the order.

      • Optional Extras are charged per individual photo in addition to the base scanning rate.

      • Standard loose photos must not exceed 21cm x 29cm.

      • Loose photos should be reasonably clean and free from Blu Tack, tape, cardboard frames, adhesive residue, staples, paper clips, or other attachments.

      • Non-loose photos, framed photos, Polaroids, mounted photos, or photos requiring removal from albums may incur additional handling fees.

    • Scan Quality & Original Condition
      The quality of digital scans depends heavily on the condition and quality of the original materials provided.
      Dust, scratches, fading, fingerprints, creases, stains, colour degradation, adhesive residue, mould, water damage, and other physical wear or defects present in the original materials may appear in the final scans.
      While Snapshot Memories takes reasonable care during handling and scanning, we do not guarantee restoration, colour accuracy, defect removal, or enhancement outcomes unless explicitly agreed as part of a paid enhancement service.

    • Album scans - loose leaf
      We may remove and replace photos contained within loose leaf albums subject to the applicable handling fee.

    • Album scans - self adhesive
      We will make reasonable attempts to remove and scan photos contained within self-adhesive albums.
      Where photos cannot be safely removed, Snapshot Memories may scan the photos in place.
      Customers acknowledge that older self-adhesive albums may contain fragile adhesives or deteriorated materials that increase the risk of damage during handling.

    • Polaroid scans
      Standard Polaroid and Instax photos may be scanned subject to condition and handling suitability.

    • Other photo scans
      Non-loose photos, framed photos, mounted photos, oversized photos, or photos attached to albums or backing materials may be eligible for scanning subject to inspection and additional pricing.

    • Digital photo ordering
      We make best efforts to preserve the order and grouping of photos provided. However, exact ordering cannot be guaranteed for all collections, particularly where originals are loose, mixed, or inconsistently organised.     • USB Stick
      If you opt for USB delivery, the brand, type, capacity, and appearance of the USB device supplied may vary depending on availability and operational requirements.

    • Download Links
      If you select digital download delivery, Snapshot Memories will provide access to your files via secure cloud delivery.
      A Digital Delivery & Storage Service fee may apply per order. This fee covers file preparation, upload processing, secure digital delivery, hosting, and temporary online storage.
      Digital files are generally available for download for approximately 6 months from the date of delivery, after which they may be permanently deleted without further notice.
      Customers are solely responsible for downloading and maintaining their own backups of delivered files.
      Snapshot Memories does not guarantee permanent archival storage or uninterrupted access to digital files.

    • Photo Enhancement
      If photo enhancement services are selected, Snapshot Memories may apply basic manual enhancements where appropriate, including:
      - Overall colour correction
      - Red-eye removal
      - Removal of minor tears and creases
      - Cropping adjustments
      - Basic exposure and contrast adjustments
      - Other minor enhancements where suitable
      Enhancement services do not include extensive digital reconstruction, advanced restoration, subject alteration, or major repair work unless separately agreed.
      Enhancement and restoration outcomes vary depending on the quality and condition of the original image. Some blur, fading, stains, scratches, colour loss, or physical damage may not be fully correctable.
      Enhancement services may slightly alter the appearance of the original digital image.

    • Return shipping
      Return shipping costs will be included in the final invoice where applicable.
      Additional packaging or protective material costs may be charged where reasonably required.
      Snapshot Memories uses reasonable care in packaging materials for return transit but is not liable for loss or damage occurring after dispatch.
      In-person collection may be arranged by prior agreement.

    • Photo storage
      Delivered files are stored using cloud infrastructure based in Australia for approximately 6 months from the date of delivery.
      Customers are responsible for downloading and maintaining their own backups once files are received.
      Files may be permanently deleted after the storage period without further notice.

    • Minimum Order
      A collective minimum order size of $99 applies to all orders.

  9. Quality Assurance
    We aim to provide high-quality digitisation services using reasonable care and skill.
    If you believe there is an issue with the quality of your completed order, please contact us within 7 days of receiving your files so we may review the matter.
    Due to the subjective nature of image quality, colour reproduction, enhancement, and restoration expectations, Snapshot Memories does not guarantee that all results will match customer expectations or memories of the original materials.

  10. Liability
    While Snapshot Memories takes reasonable care in handling customer materials, all services are provided at the customer’s risk.
    To the maximum extent permitted by law, Snapshot Memories is not liable for loss, deterioration, corruption, or damage to photographs, albums, negatives, slides, prints, digital files, or other media arising from:
    - Pre-existing damage or fragility
    - Adhesive failure or deterioration
    - Ordinary handling required to perform services
    - Environmental degradation
    - Equipment malfunction
    - Technical failures
    - Shipping or courier services
    - Events beyond reasonable control
    Some photographs, albums, negatives, slides, and printed materials may become fragile over time due to age, storage conditions, adhesives, moisture, or prior damage. While every reasonable care is taken during handling and scanning, Snapshot Memories is not liable for damage resulting from brittle materials, adhesive failure, deterioration, or pre-existing condition issues encountered during normal processing.
    To the maximum extent permitted by law, Snapshot Memories’ total liability for any claim relating to services provided is limited to the amount paid by the customer for the relevant order.
    Snapshot Memories is not liable for indirect, consequential, incidental, sentimental, or special damages.
    Nothing in these Terms excludes any rights or guarantees that cannot be excluded under Australian Consumer Law.

  11. Privacy
    Your privacy is important to us. Snapshot Memories collects and uses personal information in accordance with our Privacy Policy. Customer photos, videos, negatives, slides, and digital files are treated as private and confidential.
    Snapshot Memories does not share, publish, sell, or use customer materials for promotional or marketing purposes without explicit customer permission.
    We may use trusted third-party providers for payment processing, accounting, cloud storage, website hosting, email communications, and digital file delivery.

  12. Intellectual Property
    All original materials supplied by customers remain the property of the customer or respective rights holder.
    All digital copies and enhancements produced by Snapshot Memories remain the property of the customer upon payment in full for services rendered.
    Snapshot Memories does not claim ownership over customer content.

  13. Changes to Terms
    Snapshot Memories reserves the right to update or modify these Terms at any time.
    Updated Terms will be published on our website and take effect immediately upon publication.
    Continued use of our services after changes are published constitutes acceptance of the updated Terms.

  14. Governing Law
    These Terms are governed by the laws of Victoria, Australia.
    Any disputes arising in connection with these Terms or the use of our services will be subject to the exclusive jurisdiction of the courts of Victoria.
